On February 6, 2023, Paul was invited to guest lecture at Prof. Leann Sassine’s 2L torts class at the University of Windsor Faculty of Law.

Paul lectured on the essential evidence required to prove a claim in medical malpractice drawing on his trial experience in this challenging area of law over the years. 

Tales from the Trenches: Two Medical Malpractice Trials in 2022

On November 29, 2022, Paul presented at Gluckstein Lawyers’ 4th Annual Medical Malpractice Conference: Risky Business, in Thorold, Ontario.

 In 2022, Paul took two medical malpractice cases to trial. One before a jury and one judge-alone. In this presentation, Paul discussed first hand the ups and downs of trying a medical malpractice case in post-COVID Ontario.

On October 20, 2022, Paul and his law partner Meghan Walker presented a Webinar at the Ontario Trial Lawyers Association Roundtable series sponsored by Rehab First.

A detailed review and comparison of jury and judge-alone outcomes for motor vehicle accident claims revealed a trend towards more favourable outcomes for Plaintiffs with judges versus juries in motor vehicle accident claims.

On September 23, 2022, Paul was a member of a panel of medical malpractice lawyers at the annual Ontario Trial Lawyers Association Medical Malpractice Conference: “Literature, Medicine & The Law: A Three-Way Street.” Paul discussed issues facing medical malpractice lawyers at trial including the objection to demonstrative aids, the use of joint document briefs and the cross-examination of physician experts on medical literature.

Medical Malpractice Panel at Will Davidson LLP's Annual CLE Webinar: Ready, Set, Litigate

On September 15, 2021, Paul moderated a panel of medical malpractice lawyers. The topic was “Screening New Cases: When To Dive In and When To Run Away.”

The panel discussed their approach to screening medical malpractice claims, the challenges faced by the COVID-19 pandemic, and funding considerations when investigating new matters.

The panel also discussed recommendation options to patients, such as complaints to the College of Physicians and Surgeons of Ontario, where civil litigation is not economical.

2020 Medical Malpractice Conference: Road Map for MedMal Cases

On February 29, 2020, Paul co-chaired OTLA’s annual medical malpractice conference which featured speakers on topics such as the latest developments in the law regarding expert opinion evidence, strategies to manage defence tactics of physicians, and high risk scenarios in the ER.

This conference was specifically focussed on educating medical malpractice lawyers on current and emerging issues in their field of expertise.

On September 11, 2023, CP24 and CTV News interviewed Toronto medical malpractice lawyer  Paul Cahill with respect to his successful civil prosecution against a negligent emergency medicine physician who caused the death of a young married mother of four children. At the time of her death, the children were aged 7, 5, 4 and 2  

Inside Medical Malpractice Podcast - Medication Errors

On November 7, 2022,  Paul discussed the subject of medication errors which are so pervasive they make up 3 of the 15 “Never Events” in healthcare in the popular podcast Inside Medical Malpractice.

There are 10 basic “rights” to medication administration which are considered basic knowledge for all healthcare providers. If followed correctly, these “rights” are meant to prevent errors.

Paul presented several cases from his own practice that involved nurses, doctors and pharmacists giving the wrong drug, or the wrong dose, at the wrong time, without any follow up. 

This episode offers solid advice to healthcare providers and the public on how to avoid medication errors, and Paul offers his own advice for the lawyers who litigate these cases

Appeals court upholds $11.1 million verdict against Niagara doctor for not maintaining proper standard of care

In this article published by the St. Catherines Standard on July 13, 2020, Paul was again interviewed by Bill Sawchuk on his appeal win from his monumental trial victory in an obstetrical medical malpractice case.

Bernice Booth and Michael Woods sued their former obstetrician, Dr. Allan Jackiewicz of Niagara Falls, on behalf of their daughter Kelsey for not maintaining the standard of care.

The result was brain damage that left Kelsey with “catastrophic cerebral palsy.”

“I would say the family is overjoyed with the result from the court and the decision to dismiss the physician’s appeal,” said their lawyer, Paul Cahill of the Toronto-area firm Will Davidson LLP. “They are very much looking forward to focusing on using the funds they will hopefully now receive to make Kelsey’s life better.”

Auto-injury ruling in Girao v. Cunningham a landmark for self-represented litigants, lawyers say

In this article published by the Law Times on May 11, 2020, Paul was interviewed for his opinion on this landmark case for self-represented litigants. 

 “This plaintiff had some medical evidence that was supportive of her position, and through legal maneuvering the defence lawyers, with the approval of the trial judge, were able to block her from leading that evidence,” Cahill says. “On the other side of it, the defence was able to cherry pick the good medical evidence without leading all of the evidence by delivering briefs that were redacted in certain parts that they felt were harmful.

“At a very high level, that’s offensive to our sense of justice.”

Jury awards Niagara family $11.5 million in lawsuit against obstetrician

In this article published by the St. Catherines Standard on April 15, 2019, Paul was interviewed by Bill Sawchuk on his recent trial victory in an obstetrical medical malpractice case.

 The jury returned a verdict of liability against the doctor in the case which took almost a decade to make its way through the court system and concluded with a three-week trial in Kitchener. 

The jury returned its verdict Friday after deliberating for parts of two days.

“It was an emotional verdict,” said lawyer Paul Cahill of the Toronto-area firm Will Davidson LLP. “Two of the jurors were in tears when the verdict was read. Everyone was very emotional.

“You can imagine a lifetime of caring for a disabled child and finally getting the recognition that it was the fault of someone else. It was a very powerful moment.”
