Permanent Undertaking

A permanent undertaking is a binding written commitment a regulated health professional gives to their College, often to permanently resign from practice and never to reapply for registration in the province. Such undertakings frequently resolve serious discipline matters, allowing the regulator to secure a lasting public-protection outcome without the time and expense of a contested hearing.

Because an undertaking of this kind can have the same practical effect as revocation, it is treated as a significant outcome and is recorded on the public register. Undertakings are regulatory instruments directed at protecting the public; they do not compensate any patient who was harmed, who must pursue a separate civil claim. They commonly feature in cases involving sexual abuse, serious incompetence, or conduct that makes continued practice untenable.

Posts tagged Permanent Undertaking analyze Ontario discipline matters resolved by an undertaking to resign or to cease practising, and their relationship to civil claims.
