Vaccine Exemption

A vaccine exemption is a determination that a person should not receive an immunization that would otherwise be expected or required, and in the medical context it usually takes the form of a physician-provided medical exemption. The College of Physicians and Surgeons of Ontario sets out expectations for when and how physicians may provide such exemptions, grounded in legitimate medical contraindications.

Vaccine exemptions became a prominent subject of discipline during the COVID-19 period, when some physicians faced regulatory action for issuing medical exemptions said to lack a proper clinical basis, or for related conduct. These matters are regulatory, directed at public protection and the integrity of the profession, and are distinct from civil claims. The standard against which an exemption is judged is the accepted medical basis for a contraindication, a matter of expert and policy evidence.
